1. Scope of Application

1.1 These Terms of Service define the terms and conditions for participation in the “5-Star Creator Strategy” program (hereinafter the “PROGRAM”) by XM-Marketing LLC (hereinafter the “COMPANY”) as applicable at the time of contract conclusion.

1.2 We do not recognize any terms and conditions that conflict with or deviate from these Terms of Service unless expressly agreed upon in writing. Performance does not imply agreement to divergent terms.


2. Contract Partner

By entering into the PROGRAM agreement as outlined in section 3, the CLIENT concludes a contract with:

3. Conclusion of Contract

3.1 To enroll, the CLIENT completes a registration form and provides contact and billing details. The agreement becomes effective upon successful payment and receipt of a confirmation email from the COMPANY.

3.2 By submitting the registration form, the CLIENT accepts these Terms of Service as binding.

3.3 If the agreement is made via a written contract rather than the website, it is effective upon mutual signature and confirmation of payment.


4. Service Description

4.1 After confirmation, the CLIENT receives access to onboarding instructions and program materials.

4.2 The PROGRAM includes strategy sessions, training content, tutorials, and optionally, group or 1-on-1 sessions as outlined in the program materials.

4.3 Access is granted to an online platform that facilitates collaboration and content delivery.

4.4 The CLIENT will receive coaching support via designated communication channels (e.g., Slack or email) with a response window of up to 48h during weekdays.

4.5 Weekly live Q&A or strategy sessions may also be part of the program offering.


5. Goals of the 5-Star Creator Strategy

The PROGRAM aims to equip the CLIENT with:

  • A personalized content strategy

  • A roadmap for collaborations with hotels and tourism brands

  • Tactical knowledge to grow visibility, pitch professionally, and create high-converting visual content


6. Terms of Payment

6.1 The CLIENT may choose between full payment or an installment plan and can pay via credit card, PayPal, or bank transfer.

6.2 The first payment (either full or first installment) is due immediately upon registration.

6.3 If payment fails, the CLIENT must inform the COMPANY promptly. If no payment is made, the contract is void.

6.4 The COMPANY reserves the right to revoke access in case of late or missing payments.

6.5 Default interest, collection fees, and legal recovery costs are the responsibility of the CLIENT.

6.6 CLIENT is responsible for any applicable taxes or fees.


7. Right of Withdrawal / Refund Policy

7.1 The CLIENT may withdraw from the contract and request a refund within 30 days of purchase under the conditions of our Money-Back Guarantee (see section 7.3). Outside of this window, refunds are excluded.

7.2 Upon purchase, the CLIENT receives access to the PROGRAM content for a minimum duration of five (5) years from the date of enrollment.

7.3 30-Day Money-Back Guarantee:
To ensure satisfaction, we offer a 30-day refund policy if the CLIENT has actively participated and implemented the program content. To qualify for a refund, the CLIENT must:

  • Have accessed and completed the lessons provided within the first 30 days

  • Submit proof of completed assignments, such as pitch drafts, content examples, and outreach efforts

  • Demonstrate that, despite reasonable effort, no meaningful progress or results were achieved

7.4 Refunds are not granted to CLIENTS who:

  • Do not engage with the content

  • Do not complete or apply the assignments

  • Simply change their mind without showing evidence of participation

7.5 To request a refund, the CLIENT must contact the COMPANY via email at hey@genius-travelers.com, including all required documentation. Approved refunds will be processed within 7–10 business days.

7.6 This policy is in place to maintain the integrity and effectiveness of the PROGRAM for committed participants.


8. CLIENT Obligations

8.1 CLIENT must provide truthful information and update contact details as needed.

8.2 Unauthorized access, sharing of accounts, or technical interference is prohibited.

8.3 CLIENT is responsible for any content they submit and must ensure it does not:

  • Contain illegal or offensive content

  • Violate third-party rights

  • Include harmful software

8.4 CLIENT must respect copyright, trademark, and personal rights of others, including other members.

8.5 The PROGRAM is for professional use only.

8.6 CLIENT may not use the COMPANY’s name or branding without written permission.

8.7 CLIENT agrees to collaborate with their assigned coach and the COMPANY team.

8.8 Materials and knowledge from the PROGRAM must not be copied or used to compete with the COMPANY. Direct or indirect competition, solicitation of staff or clients, or replication of business models may result in a contractual penalty of $85,000.

8.9 The COMPANY reserves the right to suspend access in case of breach of these terms.


9. Missed Sessions

9.1 CLIENT must notify the COMPANY of missed sessions at least 24h in advance.

9.2 CLIENT remains responsible for payment, even if sessions are missed.

9.3 If COMPANY must reschedule, an alternative appointment will be offered.


10. Rights of Use

10.1 CLIENT is granted a non-transferable, non-exclusive license to use PROGRAM content for internal purposes.

10.2 All other rights remain with the COMPANY unless explicitly stated otherwise.


11. Warranty & Liability

11.1 COMPANY makes no guarantees about the accuracy or results of the PROGRAM.

11.2 Downtime or technical issues may occur, and COMPANY is not liable for temporary unavailability.

11.3 Success depends on CLIENT’s own efforts and implementation.

11.4 COMPANY is liable only for gross negligence or intentional misconduct. Liability for indirect or consequential damages is excluded.

11.5 COMPANY is not liable for force majeure events such as war, natural disasters, or legal changes.


12. Data Protection / Cookies / External Links

12.1 COMPANY adheres to GDPR and applicable data laws.

13. Applicable Law & Jurisdiction
